Hope you are having a GREAT 2010!

Heard your morning update on Medina..... I understand it but I really don't give a damn.  Democrat and Republican politicians - nearly all can go to hell.  The despise and distaste that I have for it all overrides any sensibilities that I might have had on how the system might work.  I am about ready for the entire system to be torn down and rebuilt from the ground up.

Yep, I'll probably vote for Medina in the primary and we will see who I might vote for in the general.  My vote is supposed to count so be it an Independent, Tea Party, or Libertarian -  I want conservatism, someone new and future term limits.  If we get a terrible liberal - so be it!  May the destruction be swift, painful and to the ashes!

I've been a listener of your show for the last year.  This is the first time I have ever been compelled to write you.  The man who called in to your show around 8:30 or so who was adamant in his stance this country is horrible and Canada and England have better health care just made me so angry!  I tried to call in to no avail!  So here is my rant!!

First, he needs to move OUT of this great country. Second, he needs to get educated!  Has he never heard of Medicare, Medicaid, State and local services that provide everything anyone needs?  In this country today WE (the taxpayers who WORK and PAY taxes!!) provide any low income individuals housing, food, health care and the list goes on and on!

I am so sick and tired of people like him running down our great country and promoting class envy any time they speak.

Have you considered that Team Leach and Mike Leach supporters in general understand that he will not be back as our coach.  It's kinda like the attacks of 9/11/2001.  Of all the Americans who were outraged and ready to sign up to fight on Sept. 12, very few retain their passion for justice.  With regard to Leach's termination, most people are already saying, "move on."  Some of us are still steaming about the way the smug bastards in the TTU administration treated our coach and believe several of them should get the same treatment they dealt Leach.

It isn't just pot hole repair that isn't happening.  I have called the
city numerous times over the last 6 months to get a missing "backplate"
on a traffic light replaced. (The backplate is the flat plate that
surrounds the traffic lights so that the glare from a rising or setting
sun is somewhat blocked and makes the lights more easily seen).  I now
call once per month to re-request someone from the traffic engineering
department to at least go and look at it.  Guess what?   I hasn't been
fixed!  Is anybody tending the store down at city hall?  And they wonder
why citizens are critical.

I agree that a few amendments need to be made to the charter for the municipal corporation of the City of Lubbock. Here are a few that crooks in the local government will fight to the very end.

It is already a criminal (misdemeanor) offense for any employee or officer to accept from any person, firm, or corporation, any  gift, free pass service, or any thing of value on terms more favorable than granted to the public [Article IX section 4]. The charter should be amended to make such violation a felony with a minimum penalty equivalent to 6 months of salary and benefits, or 2 years in jail if the criminal doesn't pay the fine upon conviction or plea bargain.
Going to a concert is not a necessary part of a councilman's duties of service, so accepting such free pass from any person (even a municipal employee) is still acceptance on terms more favorable than granted to the public. The same goes with accepting and using VIP parking spaces at the Municipal auditorium UNLESS it is also granted to all members of the public. However, it would not be a VIP lot if it was granted to the public, would it? If police protection in the public parking lot is insufficient for the Mayor, then it is insufficient and substandard for John Q Public as well.

Municipal employees must NOT be allowed to pick and choose which laws they will obey or enforce. If a law is unjust, then it is their responsibility to coerce the governing authority to repeal such law. Breaking any law or failing to perform any portion of employment MUST result in immediate termination.

Health care for municipal employees, with the exception of injuries on the job site, should be outlawed within the charter. If the national health care program is not good enough for them, then public servants with weapons should use them to coerce federal legislators to create a just and fair program for all citizens. After all, if government officials with weapons won't do anything about unjust and unfair government regulations and services, then who will (Revolutionaries? Terrorists?)?

It should be a misdemeanor for any municipal employee to take home any taxpayer [municipal] property valued up to $999.99
It should be a felony for any municipal employee to take home, or use for private enjoyment, any taxpayer [municipal] property valued at $1,000.00 or above. This includes, but is not limited to municipal vehicles, especially those overtly marked as police vehicles.

It should be a felony for any municipal employee ,with the exception of technicians while servicing such equipment OR persons who are scheduled to turn off such equipment while closing down portions of buildings or machines that are no longer in use for that day, to turn off any municipal video camera or recording device. Vehicles with obsolete tape recorders are to be recording throughout the entire shift. A commonly available T160 tape can record for 8 hours in EP mode on a very cheap common machine. After all, when an officer switches the recording device into the off position, what is he deliberately hiding from the public, and internal affairs? No public servant has any right to privacy while on duty.

It should be a felony for any member of the governing authority to discuss anything that could affect municipal operations, with any other official or municipal employee unless in front of live video cameras (with microphones) in which such feed is available to any citizen who desires to watch such activity either by local cable or internet. This should reduce corrupt back room dealings. Governing authority members in "back room" secret meetings should be removed from public service permanently. Again, public servants have no right to privacy while performing any municipal action.

Free movie passes and other bribes for police officers should be eliminated entirely.

It should be unlawful [misdemeanor for 1st violation, felony for any additional violation] for any municipal employee to use any municipal equipment, or municipal uniforms while privately employed. There should be no reason, except for fraud, for anyone to wear a uniform with corporate markings that are not the employer for that instant of time. This includes but is not limited to Lubbock police officers. However, it shall not be an offense to wear municipal clothing if stopping in a place for a very short duration when going to work from home, or when going home from work. If a cop wants to be a mall guard in his off time, then he can wear a mall guard uniform while being paid by the mall. You can only serve one master at a time, and while being paid by such master, your uniform should represent that master.

It should be a violation with a minimum penalty equal to 9 months pay and benefits, for any municipal employee or official to contract a private service for themselves or household family members, if a similar municipal service is available. If the public schools are substandard or unsafe for the child of a municipal official, then such official should use his or her power to correct the substandard service and/or make the schools safe for all citizens on any municipal property. When a school teacher puts her own child in a private school, that should be proof of her incompetence to make the schools adequate for all students. Using influence to put a family member into a school of the municipal employee's choice would be, at the very least, accepting a service on terms more favorable than granted to the public, and should subsequently be convicted.

If a municipal employee is indicted for an offense, the person should immediately be removed from the payroll until the situation is fully adjudicated (by conviction, dismissal, etc). If the person is not working, the person should not receive any pay or benefits. After all, the taxpayers have to pay for substitute workers to perform the duties, and it is unfair and unjust for the taxpayers to pay for those who don't work. Under the constitution, the accused shall enjoy the right to a speedy and public trial, by an impartial jury. If the accused employee or official wants to postpone speedy trials, then he can do so without pay due to his delay. If the municipal courts take too long for the speedy trial, then it is a sign on municipal employee incompetence. Such incompetent employees shall be terminated and replaced.

There should be a payroll cap for the city manager's office not to exceed $250,000.00. If the manager wants to hire assistants, (s)he can do so out of that budget. If (s)he wants all of the money, than (s)he can do all of the work. At least the budget would not include medical insurance because that should be outlawed by one of the amendments above.

It should be unlawful to issue tenure or similar titles for long term employees. Rank and salary should be based on performance and test scores, period. No additional points shall be added to any tests for length of service. If the long term employee is exceptional at the job, then you can rest assured that (s)he would have exceptionally high scores on standardized service tests. Those who earn higher rank shall enjoy higher salaries, but those who earned lower scores due to mediocre knowledge of duties, shall not receive any raises or increased privileges or benefits. Mediocre and substandard employees should be terminated and replaced.

Any and all  "golden parachutes" should be outlawed for municipal employees or officials. If the person needs to be replaced for substandard performance, then there should be no reason to give such substandard person any additional pay or benefits. Since golden parachutes are not granted to the public, then it should be a felony under the amended Article IX section 4 for any employee to accept such parachute, and such felon should be convicted.

The portion of the charter that exempts municipal property and personnel from execution of any law or attachment, MUST be eliminated. No municipal person or property should be exempt from the laws and regulations imposed onto the people and their property. If municipal property is in violation of any municipal code, then that same municipal corporation shall have no legal or moral right to accuse or convict any person of violating a code that the accusing corporation is also violating. Any laws imposed upon the public, MUST be imposed at least as harsh upon municipal employees and municipal properties. If a code is too harsh for the city to be in compliance, then how can those without political power ever expect to be in compliance.

Waivers (for building regulations or other laws), should be removed from exclusive city council control and placed into an authority with 50% private sector personnel. The council shall be half (if all council members are attending, and have not been recused for conflict of interest) The private sector personnel of 7 (it shall be 7 even if some or all council members are absent) shall be selected at random (and conformed to be a random selection) by those who signed in and are attending the waiver (or revocation) meeting who are NOT employees or representatives (directly or indirectly) of the company or person seeking the waiver, nor are representatives (directly or indirectly) of any municipal office or employee. Waivers issued within the past 2 years shall be brought before the new authority, and if at least half of the private sector people do not approve such waiver, it shall be subject to the full waiver authority for a new public review and approval or revocation vote. If a merchant received a waiver to sell alcohol next to a school, such merchant may still sell such alcohol purchased during the council issued waiver, but may not lawfully have additional alcohol delivered to such merchant if such waiver is subsequently revoked. If a council member does not desire to share power when considering granting or revoking waivers to laws and regulations imposed upon the public, then such council members have the right to immediately resign their position, and don't have to share any power, because they are giving up their portion of the power entirely. Again, this should reduce the effects of unlawful back room dealings with wealthy people that can afford to give unlawful bribes so they can circumvent the laws imposed upon others.

I would like to see a "bonehead maneuver avoidance clause" put in the
charter.  I would like the charter to specify that the council may not
bind the city to huge debt loads beyond a certain percentage of the
annual budget.  These "big ticket" items like the LPL debacle should go
to the voters for approval.  I think maybe a similar statement
controlling long term lease agreements might also be helpful to keep the
council from throwing money at rental property like the Goedeke Library
move.

Obama set a lousy and dangerous precedent last night, he flatly stated that the defense of this country is contingent upon how much it would cost. He said in effect, that the constitutionally mandated function of the federal government, and the very reason for its existence, DEFENSE, is less important than trillions of dollars of unconstitutional domestic spending and meddling.

The Union was not formed so that the States and people would have some magical source of never ending money ( our money by the way) along with the profound wisdom and guidance for the living of our lives. The primary reason for the formation of the union was common defense, without it the union serves no legitimate function, and has no legitimate reason to collect taxes. Without defense the union may as well be dissolved, with all powers returning to the States and people.

 We can spend ourselves into oblivion, we dont need to hire specialists.  Im done.

Don't forget the long term tax implications with this deal.  Xcel energy
is one of the largest taxpayers in Lubbock since they have large tracts
of land and large buildings.  All of this will go off the list of
taxable property and be yet another Lubbock owned non-tax producing
property.  The lost taxes must be figured into the cost of this deal.
PS.....I had better stop seeing full page color ads for LP&L since there
will be no reason to attract or retain customers.

Ahh, the old 'living-breathing' argument, one voiced by the constitutionally ignorant. The constitution itself contains the recipe for change, its called the amendment process. Its interesting that the president has no role in this process, and cannot veto an amendment proposal or ratification.
The process is difficult on purpose.

By the way the 'general welfare' clause is in the preamble, "promote the general welfare". We the people established the constitution in order to promote the general welfare of the people, it is in no way a governmental power, in fact it is rightly argued that the constitution is there to LIMIT government in order to promote the general welfare.

Get Dr. Henry at Tech (turf Dr.) and get him to get some grants to do large, high traffic turf variety turf research to get some really good turf varieties.  Use "Back to Nature" cotton bur and cow manure (keep the dollars local) to make the soil better....and then pipe some of the water from the pump that is filling the cayon lakes just inside the loop to water the fields.  Perhaps even get a grant to do that.   How is that for about 2 minutes of thinking?

Wanted to ask Rex (since he has a legal background) a question about littering?

It seems that sometime this morning that someone threw out trash into my driveway.  Looking down the street as I drove to work, I saw that it happened to several other houses.  Now, it looked like the trash was probably a very thin rolled up Avalanche Journal.  I do not subscribe nor did I ask for a free subscription.  Truly, can I file a complaint against the AJ for this?  I know for sure that several of these will never be picked up and thrown away.   Please ask what Rex thinks.

Amazing, I have been hearing people telling them to do that for years, are these soccer folks that hard headed? Its amazing how much people can do without government, of cours that would require more effort than just holding out your hand, palm up.

The media will not report the number of enemy dead because it will make our military look too good!  American's rally behind the cause when we kill many more enemy than they kill of us.  It makes the war look winable, exactly what the democrats DON'T want.  Even 1 American death is too many.  But if we kill 10 to our 1 loss or 20 or 30....you get my point.

WWII was the prime example.  Casualties were reported on both sides.  At the beginning it looked pretty grim.  By Okinawa (where my father fought) we were killing 12 or 13 to our 1 loss (more than 8000 Americans killed but more than 100,000 enemy kia).  Still not acceptable, no American loss is, but at least you see the light at the end of the tunnel.
